CBC Law, kişisel verilerin korunmasına ilişkin 6698 sayılı Kişisel Verilerin Korunması Kanunu (‘‘Kanun’’) ve sair mevzuat tarafından getirilmiş ilke ve kurallara uymayı; verileri işlenen bireylerin hak ve özgürlüklerini korumayı taahhüt etmektedir.

Kişisel Verileriniz İşlenirken Hangi İlkelere Uygun Hareket Edilir?

Tüm kişisel veri işleme faaliyetleri, aşağıdaki veri koruma ilkeleriyle uyumlu olarak gerçekleştirilmektedir:

Hukuka ve dürüstlük kurallarına uygun olma,
Doğru ve gerektiğinde güncel olma,
Belirli, açık ve meşru amaçlar için işlenme,
İşlendikleri amaçla bağlantılı, sınırlı ve ölçülü olma,
İlgili mevzuatta öngörülen veya işlendikleri amaç için gerekli olan süre kadar muhafaza edilme.

Kişisel Verileriniz Hangi Hukuki Sebepler Doğrultusunda İşlenir?

Kişisel veriler ancak Kanun’a ve ilgili mevzuata uygun olarak işlenebilir. Buna göre kişisel verilerin işlenmesi için aşağıdaki koşullardan birinin bulunması aranır:

Veri sahibin açık rızasının alınmış olması,
Kanunlarda açıkça öngörülmesi,
Fiili imkânsızlık nedeniyle rızasını açıklayamayacak durumda bulunan veya rızasına hukuki geçerlilik tanınmayan kişinin kendisinin ya da bir başkasının hayatı veya beden bütünlüğünün korunması için zorunlu olması,
Bir sözleşmenin kurulması veya ifasıyla doğrudan doğruya ilgili olması kaydıyla, sözleşmenin taraflarına ait kişisel verilerin işlenmesinin gerekli olması,
Bir hukuki yükümlülüğün yerine getirilebilmesi için zorunlu olması,
İlgili kişinin kendisi tarafından alenileştirilmiş olması,
Bir hakkın tesisi, kullanılması veya korunması için veri işlemenin zorunlu olması,
İlgili kişinin temel hak ve özgürlüklerine zarar vermemek kaydıyla, meşru menfaatler için veri işlenmesinin zorunlu olması.

Kişisel Verileriniz Hangi Amaçlar Doğrultusunda İşlenir?

Kişisel veriler aşağıdaki amaçlarla sınırlı olarak Kanun’a ve ilgili mevzuata uygun olarak işlenebilir:

Bilgi güvenliği süreçlerinin yürütülmesi,
Çalışan adayı seçme ve yerleştirme süreçlerinin yürütülmesi,
Çalışanlar için iş akdi ve mevzuattan kaynaklı yükümlülüklerin yerine getirilmesi,
Finans ve muhasebe işlerinin yürütülmesi,
Hukuki danışmanlık ve dava hizmetlerine ilişkin süreçlerin yürütülmesi,
İletişim faaliyetlerinin yürütülmesi,
İnsan kaynakları süreçlerinin planlanması
İş faaliyetlerinin yürütülmesi,
İş sürekliliğinin sağlanması faaliyetlerinin yürütülmesi,
Müvekkil ilişkileri süreçlerinin yürütülmesi,
Sunulan hukuki hizmet gereği ilgili mahkeme, icra dairesi ve ilgili kurumlara bilgi verilmesi,
Saklama ve arşiv faaliyetlerinin yürütülmesi,
Sözleşme süreçlerinin yürütülmesi,
Yasal düzenlemeler uyarınca taahhüt edilen yükümlülüklerin yerine getirilmesi,
Yetkili kişi, kurum ve kuruluşlara bilgi verilmesi.

Kişisel Verileriniz Hangi Yöntemler ile Toplanır?

Kişisel verileriniz tarafımıza elektronik veya fiziki yolla ileteceğiniz dokümanlar ve bilgiler aracılığıyla sözlü, yazılı veya elektronik ortamda otomatik olan ya da olmayan yollarla toplanmaktadır.

Kişisel Verileriniz Kimlere Aktarılabilir?

İş faaliyetlerimizin yürütülmesi kapsamında özellikle teknik uzmanlık gerektiren hususlarda iş ortaklarımız ve tedarikçilerimiz ile birlikte çalışıyoruz. Bu doğrultuda, size sağladığımız hizmetin teknik uzmanlık gerektirmesi halinde verileriniz iş ortaklarımız ve/veya tedarikçilerimizle paylaşılabilecektir.
Yasal düzenlemeler ve tabi olduğumuz mevzuat gereği, mevzuatta açıkça yetkilendirilmiş kişilerle, bir mahkeme kararı uyarınca veya yetkili kılınmış idari mercilerin talebi üzerine yetkili kişi veya kamu kurum ve kuruluşları ile paylaşılabilecektir.

Kişisel Verileriniz Ne Kadar Süre ile Saklanır?

Kişisel verileriniz, Kanun’da veya ilgili mevzuatta verinin saklanması için bir süre belirlenmişse söz konusu veri en az bu süre kadar saklanmak zorundadır. Kanun’da veya ilgili mevzuatta bir süre öngörülmemişse; işlenme amaçlarıyla bağlantılı, sınırlı ve ölçülü olmak kaydıyla belirlenen makul sürelerce saklanmaktadır. İşlenme amaçları için gerekli süresi dolan veya veri sahibinin haklı talebi üzerine kişisel veriler, mevzuata uygun şekilde anonimleştirilir, silinir veya yok edilir.

Veri Güvenliği Kapsamında Hangi Tedbirler Alınır?

Kişisel verilerin hukuka aykırı olarak açıklanmasını, erişimini, aktarılmasını veya başka şekillerde meydana gelebilecek güvenlik eksikliklerini önlemek için, imkanlar dahilinde, korunacak verinin niteliğine göre gerekli her türlü tedbir alınmaktadır.

Çocuklara Ait Kişisel Veriler

CBC Law, 18 yaşın altındaki kişilerin kişisel verilerini korumanın öneminin farkındadır. İnternet sitemiz 18 yaşının altındaki kişilere yönelik değildir. 18 yaşın altındaki kişilere ait kişisel verilerin hukuka aykırı olarak toplandığını öğrenmemiz durumunda söz konusu veriler mümkün olan en kısa sürede silinecektir. Veli veya vasilerin, gözetimleri altındaki çocukların kişisel verilerini internet sitemiz üzerinden paylaştıklarına dair bir şüpheleri olması durumunda, bu verilere ilişkin bizimle "info@cbclaw.com.tr" elektronik posta adresi üzerinden irtibata geçmelerini rica ederiz.

İnternet sitemiz, kontrolümüz altında olmayan diğer internet sitelerine bağlantılar içerebilir. CBC Law, diğer internet sitelerinin içeriklerinden veya gizlilik uygulamalarından sorumlu değildir. Ki̇şi̇sel Veri̇leri̇ni̇ze İli̇şki̇n Haklarınız Nelerdir?

Kişisel verilerinize ilişkin;

Kişisel verilerinizin işlenip işlenmediğini öğrenme,
Kişisel verileriniz işlenmişse buna ilişkin bilgi talep etme,
Kişisel verilerin işlenme amacını ve bunların amacına uygun kullanılıp kullanılmadığını öğrenme,
Yurt içinde veya yurt dışında kişisel verilerinizin aktarıldığı üçüncü kişileri bilme,
Kişisel verilerinizin eksik veya yanlış işlenmiş olması halinde bunların düzeltilmesini isteme,

Haklarınızı Nasıl Kullanabilirsiniz?

Kişisel verileriniz ile ilgili başvuru ve taleplerinizi;

Geçerli bir kimlik belgesi ile bizzat başvurarak,
Islak imzalı ve kimlik fotokopisi ile "Akat Mah. Cebeci Cad. No:24 Beşiktaş, İstanbul" adresine göndererek,
"info@cbclaw.com.tr" adresine elektronik posta göndererek

CBC Law’a iletebilirsiniz.

Veri Sorumlusuna Başvuru Usul ve Esasları Hakkında Tebliğ (“Tebliğ”) uyarınca, başvurunuzda isim, soy isim, başvuru yazılı ise imza, T.C. kimlik numarası, (başvuruda bulunan kişinin yabancı olması halinde pasaport numarası), tebligata esas yerleşim yeri veya iş yeri adresi, varsa bildirime esas elektronik posta adresi, telefon numarası ve faks numarası ile talep konusuna dair bilgilerin bulunması zorunludur.

Başvuru, yukarıda belirtilen hakları kullanmak için yapacağı ve kullanmayı talep ettiği hakka ilişkin açıklamaları içermeli ve başvuruda talep edilen husus açık ve anlaşılır şekilde belirtilmelidir. Başvuruya ilişkin bilgi ve belgelerin başvuruya eklenmesi gerekmektedir.

Talep konusunun başvuranın şahsı ile ilgili olması gerekmekle birlikte, başkası adına hareket ediliyor ise başvuruyu yapanın bu konuda özel olarak yetkili olması ve bu yetkinin belgelendirilmesi (vekâletname) gerekmektedir. Ayrıca başvurunun kimlik ve adres bilgilerini içermesi ve başvuruya kimliği doğrulayıcı belgelerin eklenmesi gerekmektedir. Yetkisiz üçüncü kişilerin başkası adına yaptığı talepler değerlendirmeye alınmayacaktır.

Kişisel Verilerinizin İşlenmesine İlişkin Talepleriniz Ne Kadar Sürede Cevaplanır?

Kişisel verilerinize ilişkin talepleriniz değerlendirilerek, CBC Law’a ulaştığı tarihten itibaren en kısa sürede ve en geç 30 gün içinde cevaplandırılır. Talebinizin kabul edilmesi veya gerekçesi açıklanarak reddedilmesi halinde cevabımız başvuruda belirttiğiniz adrese posta veya elektronik posta yolu başta olmak üzere eğer mümkünse talebinizin yapıldığı usulle size iletilir. Değerlendirme ve karar verme işleminin ayrıca bir maliyeti gerektirmesi durumunda Kişisel Verileri Koruma Kurulu tarafından belirlenen tarifedeki ücret esas alınır.

Politikanın Güncellenmesi

İşbu Politika hükümleri, herhangi bir zamanda ve herhangi bir sebepten dolayı bildirimde bulunmaksızın değiştirilebilir veya yenilenebilir. Değişiklik yapılan hükümler, internet sitemizde yayımlandığı tarihte yürürlük kazanır.

Personal data can only be processed in accordance with the Law and relevant legislation. Therefore, one of the following conditions is required for the processing of personal data:

Explicit consent of the data subject,
It is expressly provided for by the laws.
It is necessary for legitimate interests, provided that it does not harm the fundamental rights and freedoms of the data subject Processing of personal data of the parties of a contract is necessary, provided that it is directly related to the establishment or performance of the contract.
It is necessary for compliance with a legal obligation to which the data controller is subject.
Personal data have been made public by the data subject.
Data processing is necessary for the establishment, exercise, or protection of any right.
Processing of data is necessary for the legitimate interests pursued by the data controller, provided that this processing shall not violate the fundamental rights and freedoms of the data subject.

What are the Purposes of Processing Your Personal Data?

Personal data may be processed in accordance with the Law and relevant legislation limited to the following purposes:

Conducting information security processes,
Conducting employee candidate selection and recruitment processes,
Fulfillment of employment contractual and regulatory obligations for employees,
Conducting financial and accounting affairs,
Conducting processes related to legal counseling and litigation services,
Conducting communication activities,
Planning of human resources processes,
Conducting business activities,
Carrying out activities to ensure business continuity,
Conducting client relations processes,
Providing information to relevant courts, execution offices, and related institutions due to the legal services provided,
Carrying out storage and archive activities,
Execution of contract processes,
Fulfillment of obligations undertaken in accordance with legal regulations,

Which Methods Are Used to Collect Your Personal Data?

Your personal data is collected through automated or non-automated methods, including verbal, written, or electronic means. This includes information provided to us electronically or physically.

To Whom Can Your Personal Data Be Transferred?

As part of our business operations, we collaborate with business partners and suppliers, especially in areas demanding technical expertise. Therefore, if the service we provide to you necessitates technical proficiency, your data may be shared with our business partners and/or suppliers.
In compliance with applicable legal regulations, your data may be shared with persons explicitly authorized by the legislation. Additionally, it may be disclosed to authorized persons or public institutions and organizations in response to a court decision or at the request of the competent administrative authorities.

For What Duration is Your Personal Data Stored?

If a specific period of time is stipulated in the Law or relevant legislation for the storage of your personal data, the data in question must be kept for at least the duration of this period. In cases where a specific period is not stipulated in the Law or the relevant legislation, your data is stored for a reasonable duration determined in accordance with the processing purposes, provided that it is relevant, limited and proportionate. The personal data shall be anonymized, erased or destructed in accordance with the legislation upon the expiration of the duration required for the processing purposes of such data or upon the justified request of the data subject.

What Measures are Taken within the Scope of Data Security?

To prevent unlawful disclosure, access, transfer, or other security deficiencies that may occur through various means, we implement all necessary measures within our capabilities, tailored to the nature of the personal data to be protected.

CBC Law recognizes the importance of protecting the personal data of individuals under the age of 18. Our website is not intended for persons under 18. If we learn that the personal data of individuals under 18 has been unlawfully collected, such data will be erased as promptly as possible. What are Your Rights Regarding Your Personal Data?

Regarding your personal data, you have the following rights;

to learn whether your personal data are processed or not,
to demand for information as to if your personal data have been processed,
to learn the purpose of the processing of your personal data and whether these personal data are used in compliance with the purpose,
to know the third parties to whom your personal data are transferred in the country or abroad,
to request the rectification of the incomplete or inaccurate data, if any,

to request reporting of the operations carried out pursuant to your request of correction of incomplete or incorrect data and erasure or destruction of your personal data to third parties to whom your personal data have been transferred,

How Can You Exercise Your Rights?

You can forward your applications and requests regarding your personal data to CBC Law;

By applying in person with a valid identity certificate,
By sending it to "Akat Mah Cebeci Cad No:24 Beşiktaş, Istanbul" with a wet signature and a photocopy of your identity card,
By sending an e-mail to "info@cbclaw.com.tr"

Pursuant to Communique On The Principles And Procedures For The Request To Data Controller, your application must include your name, surname, signature (if the application is in writing), T.R. identification number (passport number if the applicant is a foreigner), residential or workplace address for notification, e-mail address for notification (if any), telephone number and fax number and information on the subject of the request.

The application must include explanations regarding the right to exercise the above-mentioned rights, the specific right requested to be exercised, and a clear and understandable statement of the matter requested. Additionally, information and documents relevant to the application must be attached.

While the subject of the request must be related to the applicant if acting on behalf of someone else, the applicant must have specific authorization in this regard, and this authority must be certified (a power of attorney is required). Furthermore, the application must include identity and address information, and documents confirming the identity must be attached to the application. Requests made by unauthorized third parties on behalf of someone else will not be evaluated.

How Long Will It Take to Receive a Response to Your Requests Regarding the Processing of Your Personal Data?

Your requests regarding your personal data will be evaluated and answered as promptly as possible and within 30 days at the latest from the date of receipt by CBC Law. If your request is accepted or rejected with an explanation of the reason, our response will be sent to you by mail or e-mail to the address you specified in the application, using the same method by which your request was made, if possible. If the evaluation and decision-making process incur additional costs, the fee shall be as determined by the Personal Data Protection Board.

Policy Updates

This Privacy Policy’s provisions are subject to amendment or renewal at any time and for any reason without prior notice. The updated provisions become effective on the date of publication on our website.
